Vereinbarung
1. Geltungsbereich
Diese Nutzungsbestimmungen gelten zwischen monstory, Marie Knaus, Sackstraße 14, 8010 Graz und dem/der jeweiligen Nutzer*in (fortan einheitlich: „Nutzer“) der von monstory angebotenen Software für mobile Endgeräte („Apps“). Sie regeln die Bedingungen für den Download und die Nutzung der App. Durch die Verwendung unserer App erklärt sich der Nutzer mit diesen Nutzungsbedingungen einverstanden.
monstory behält sich das Recht vor, diese Nutzungsbestimmungen jederzeit zu ändern. Dabei gelten die Änderungen für die jeweils aktuelle Version bzw. ab der folgenden Aktualisierung einer bestehenden Installation. Bei Aktualisierungen bestehender Installationen erscheinen die neuen Nutzungsbestimmungen automatisiert und müssen vor der weiteren Nutzung bestätigt werden.
2. Angebot von monstory
2.1 Unsere App
Unsere mobile Anwendung richtet sich vorrangig an Kinder in der Altersgruppe von 5 bis 10 Jahren. Die App ermöglicht die Erstellung von Videos mit eingebetteten grafischen Elementen sowie die Funktionen der Aufnahme von Animationen und Sprache. Die individuell erstellten Videosequenzen können von den Nutzern auf ihrem persönlichen Gerät gespeichert werden. Die Intention ist es, Geschichten durch Sprache, Kommunikation und Ausdruck mit audiovisuellen Inhalten zu kombinieren und allein oder mit anderen gemeinsam gestalten zu können. Die individuell erstellten Videosequenzen können von den Nutzern geteilt und mit anderen Nutzern der App weiterbearbeitet werden.
2.2 Technische Anforderungen
Die Hardware- und Firmware-Anforderungen zum Betreiben der App auf Endgeräten sind im App Store und Play Store aufgeführt. Für den Download der App setzt monstory eine stabile Internet-Verbindung des Endgeräts des Nutzers voraus. Nach dem Download kann der Nutzer die Inhalte unabhängig von einer Internet-Verbindung (offline) nutzen. Für das Teilen von Projektdateien ist eine Internet- oder Bluetooth-Verbindung nötig. Die Nutzer sind selbständig für die Sicherung der Inhalte verantwortlich.
3. Nutzungsbedingungen
monstory prüft die Nutzerinhalte nicht und macht sie sich auch nicht zu eigen. monstory erhebt also keinerlei Anspruch auf die mit der App erstellten Inhalte. Andererseits sind die Nutzer für die Einhaltung der gesetzlichen Regelungen für die Nutzerinhalte selbst verantwortlich. monstory behält sich vor, bei etwaigen Rechtsansprüchen durch die Verletzung der gesetzlichen Vorschriften angemessene Kosten für eine etwaige Rechtsverteidigung einzufordern, sowie sich von Ansprüchen Dritter freizustellen.
4. Urheberrecht und Nutzungsrechte
4.1 monstory-Copyright
Die mobile Anwendung und grafische Inhalte sind Eigentum von monstory. Die mobile Anwendung von monstory wurde zu Bildungs- und Unterhaltungszwecken produziert. Nutzern ist es untersagt monstory-Materialien wie Logos, Symbole, Hintergründe, Figuren und Requisiten kommerziell außerhalb der App von monstory zur verwenden. Sollte eine kommerzielle Nutzung in irgendeiner Form in Erwägung gezogen werden, ist eine explizite Genehmigung durch monstory, vertreten durch Marie Knaus, Sacktraße 14, 8010 Graz, erforderlich.
4.2 Rechte an Nutzerinhalten
monstory gewährt den Nutzern der App eine persönliche, nicht exklusive, nicht übertragbare, eingeschränkte Lizenz. Dadurch haben Nutzer das Recht die mobile Anwendung von monstory zu nutzen, um mit den Ressourcen der App Videos zu erstellen und zu bearbeiten. Die Nutzer verpflichten sich dazu, die gesetzlichen Rahmenbedingungen der Urheberschaft bzw. Teilurheberschaft zu beachten. Insbesondere darf durch einen Nutzer erstellter oder bearbeiteter Inhalt nicht ohne Zustimmung mit anderen geteilt, veröffentlicht oder verändert werden sowie generell Dritten zugänglich gemacht werden.
4.3 Keine Verletzung von Rechten Dritter durch Nutzerinhalte
Die Nutzer verpflichten sich dazu, durch das Laden und Veröffentlichen von Nutzerinhalten in der App keine Rechte Dritter, insbesondere Persönlichkeitsrechte anderer Nutzer oder geistige oder gewerbliche Schutzrechte Dritter (z.B. Urheberrechte, Designs, Markenrechte etc.), zu verletzen. Sie verpflichten sich deshalb insbesondere,
- Bilder, Texte und andere Nutzerinhalte nur dann in die App zu laden und innerhalb der App zu nutzen, wenn sie hierfür die entsprechenden Nutzungsrechte innehaben oder gesetzlich hierzu berechtigt sind.
- die Persönlichkeitsrechte anderer Nutzer zu wahren und keine beleidigenden und/oder verleumderischen Äußerungen und/oder unwahren Behauptungen in Bezug auf andere Nutzer zu veröffentlichen.
4.4 Weitere Pflichten
Die Nutzer verpflichten sich ferner,
- keine pornographischen, rassistischen, volksverhetzenden, gewaltverherrlichenden oder jugendgefährdenden oder diskriminierenden Inhalte zu veröffentlichen, und zwar unabhängig davon, ob hierdurch ein Straftatbestand verwirklicht wird.
- keine Eingriffe in die App durch technische oder elektronische Hilfsmittel vorzunehmen, die die Integrität der App betreffen oder die bezwecken, Inhalte der App auszulesen.
- keine Werbung zu veranstalten.
Die Nutzer sind selbständig für die Sicherung der Inhalte verantwortlich.
5. Haftungsausschluss
monstory gewährt keinerlei Garantien oder Gewährleistungen jeglicher Art, inklusive, aber nicht beschränkt auf Garantien für einen unterbrechungsfreien Service oder eine fehlerfreie Benutzung der App. Insbesondere wird jegliche Haftung, für mit der App erstellten Inhalte, ausgeschlossen und monstory ist für keinen Schaden finanziell haftbar zu machen.
Meinungen, Ratschläge, Aussagen sowie beleidigende, verleumderische, illegale oder obszöne Inhalte durch den Nutzer hinzugefügte Audio- und Videoaufnahmen bei der Verwendung der App von monstory werden von monstory weder befürwortet, noch trägt monstory dafür irgendeine Verantwortung.
Unter keinen Umständen sind monstory, seine Mitarbeiter oder Agenten für Verluste oder Schäden haftbar zu machen, die so entstehen könnten. monstory ist nicht verantwortlich für Verzögerungen oder Nichterfüllung, falls Ereignisse jenseits der Kontrolle von monstory vorliegen.

Terms of Use
Agreement
1. Scope of Application
These Terms of Use apply between monstory, Marie Knaus, Sackstraße 14, 8010 Graz and the respective user of the software for mobile devices ("Apps") offered by monstory. They regulate the conditions for the download and use of the App. By using our App, the User agrees to these Terms of Use.
monstory reserves the right to change these terms of use at any time. In doing so, the changes apply to the respective current version or as of the following update of an existing installation. When updating existing installations, the new terms of use appear automatically and must be confirmed before further use.
2. Offer of monstory
2.1 our App
Our mobile application is primarily aimed at children in the age group of 5 to 10 years. The App enables the creation of videos with embedded graphic elements as well as the functions of recording animations and speech. The individually created video sequences can be saved by users on their personal device. The intention is to combine stories through speech, communication and expression with audiovisual content and to be able to create them alone or with others. The individually created video sequences can be shared by users and further edited with other users of the App.
2.2 Technical Requirements
The hardware and firmware requirements for running the App on end devices are listed in the App Store and Play Store. For the download of the App, monstory requires a stable internet connection of the User's end device. After the download, the user can use the content independently of an internet connection (offline). An Internet or Bluetooth connection is required for sharing project files. Users are independently responsible for backing up the content.
3. Terms of Use
monstory does not check the user content and does not adopt it as its own. monstory therefore does not lay any claim to the content created with the App. On the other hand, users are responsible for compliance with legal regulations for the user content. monstory reserves the right to claim reasonable costs for a possible legal defense in case of any legal claims due to the violation of legal regulations, as well as to indemnify itself from claims of third parties.
4. Copyright and Rights of Use
4.1 monstory Copyright
The mobile application and graphical content are property of monstory. The monstory mobile application was produced for educational and entertainment purposes. Users are prohibited from using monstory materials such as logos, icons, backgrounds, characters and props commercially outside of the monstory App. If commercial use in any form is considered, explicit permission by monstory, represented by Marie Knaus, Sacktraße 14, 8010 Graz, is required.
4.2 Rights to User Content
monstory grants users of the app a personal, non-exclusive, non-transferable, limited license. This gives Users the right to use monstory's mobile application to create and edit videos using the App's resources. Users agree to comply with the legal framework of authorship or partial authorship. In particular, content created or edited by a user may not be shared with others, published or modified without consent and generally made available to third parties.
4.3 No Infringement of Third Party Rights by User Content
Users undertake not to infringe any third-party rights, in particular personal rights of other users or intellectual or industrial property rights of third parties (e.g. copyrights, designs, trademark rights, etc.), by loading and publishing User Content in the App. You therefore undertake in particular,
- to upload images, texts and other user content to the App and to use them within the App only if they hold the corresponding rights of use or are legally entitled to do so.
- to respect the personal rights of other users and not to publish any insulting and/or defamatory statements and/or untrue allegations regarding other users.
4.4 Further Obligations
The users further undertake,
- not to publish any pornographic, racist, inciting, violent or discriminatory content, regardless of whether this constitutes a criminal offense.
- not to interfere with the App by technical or electronic means which affect the integrity of the App or which are intended to read out the contents of the App.
- not to engage in advertising.
The users are independently responsible for securing the contents.
Disclaimer
monstory does not grant any guarantees or warranties of any kind, including but not limited to guarantees for an uninterrupted service or error-free use of the App. In particular, any liability, for content created with the App, is excluded and monstory is not financially liable for any damage.
Opinions, advice, statements, as well as insulting, defamatory, illegal or obscene content added by the User audio and video recordings when using the App by monstory are not endorsed by monstory, nor does monstory bear any responsibility for them.
Under no circumstances shall monstory, its employees or agents be liable for any loss or damage that may so occur. monstory shall not be responsible for any delay or failure to perform in the event of events beyond monstory's control.
